    Vicarious Liability for Group Companies: the Final Frontier of Vicarious Liability?

    This article seeks to explore the pressing unanswered commercial issue: whether or not a parent company can potentially be vicariously liable for its subsidiary's torts. It is currently undecided in English law, however, the theory of vicarious liability as recently expounded by the Supreme Court, as well as the development of new categories of vicarious liability, point towards vicarious liability for legal persons. This article argues that a legal (or natural) person may employ, or be in a relationship 'akin to employment' with, a legal person for the purposes of vicarious liability

    Vicarious Liability and the Beautiful Game – Liability for Professional and Amateur Footballers?

    Vicarious liability has a greater reach within both professional and amateur football than previously thought. The newly-expanded doctrine has opened up vicarious liability for amateur players, and within grassroots teams. A greater range of torts may also now trigger vicarious liability, such as acts of on and off-pitch violence. The Football Association will need to review the scope of the National Game Insurance Scheme, which significantly lags behind this expanded exposure to vicarious liability. Examining vicarious liability in the context of football also reveals significant problems with the current approach to vicarious liability within unincorporated associations. This category developed in the context of institutional abuse within highly-organised religious institutions; it does not mean that this category of vicarious liability should be applied to grassroots sporting organisations in the same way. For instance there is scope to apply a different test at stage two. It is argued that the courts will need to tighten up this category so as not to unnecessarily expose members of grass roots organisations to vicarious liability which is able to be executed against their personal assets. Both amateur and professional clubs may also wish to carefully consider their selection of players

There are two viable judgment-proofing systems available to VSOs: (1) charitable purpose trusts, and (2) group structures.     The purpose of this deliverable is to provide a single point of reference on the safety, regulatory and liability issues for operating robots in the European Union. The deliverable describes a state of the art and the well-known normative frameworks for assuring safety on the one hand and examines the regulatory and legal liability issues related to operating robots on the other. We organised the report based on the required structure of the deliverable with taking into consideration the different robots technologies, as recognised at the European Union and international level. This deliverable is closely related to other deliverables which describe the current state of the arts and normative framework from a different point of view. This review report is intended as a guiding document to be used by all project partners. There is currently no single framework to regulate robotics technology in Europe. Different types of robots, depending on where they operate—which Member State and in the air, on land, or in the waters—may be subject to various existing laws or regulations on the international, European Union, Member State levels. The regulations include legal standards and industry guidelines on the robot technologies themselves and on the developers, manufacturers, suppliers, and operators that must be met before these new technologies can be legally and safely deployed. Specific types of robots are subject to different regulatory regimes, and depending on the type of the robot, the applicable regulations may be harmonised across Europe or differ in each Member State. Current liability regimes on the EU and Member State levels govern the situations in which the humans associated with the robots are civilly liable for the damage they cause to property or injuries to persons. The appropriate legal regime could be fault-based, strict liability, or product liability depending on the particular circumstances. While existing laws are sufficient to address liability issues given the current state of the technology, further scientific advances that lead to increasingly sophisticated robots may raise problems on how to appropriately assign responsibility

    Mind the Gaps: Assuring the Safety of Autonomous Systems from an Engineering, Ethical, and Legal Perspective

    This paper brings together a multi-disciplinary perspective from systems engineering, ethics, and law to articulate a common language in which to reason about the multi-faceted problem of assuring the safety of autonomous systems. The paper's focus is on the “gaps” that arise across the development process: the semantic gap, where normal conditions for a complete specification of intended functionality are not present; the responsibility gap, where normal conditions for holding human actors morally responsible for harm are not present; and the liability gap, where normal conditions for securing compensation to victims of harm are not present. By categorising these “gaps” we can expose with greater precision key sources of uncertainty and risk with autonomous systems. This can inform the development of more detailed models of safety assurance and contribute to more effective risk control

    A survey that can cover the sky in optical bands over wide fields to faint magnitudes with a fast cadence will enable many of the exciting science opportunities of the next decade. The Large Synoptic Survey Telescope (LSST) will have an effective aperture of 6.7 meters and an imaging camera with field of view of 9.6 deg^2, and will be devoted to a ten-year imaging survey over 20,000 deg^2 south of +15 deg. Each pointing will be imaged 2000 times with fifteen second exposures in six broad bands from 0.35 to 1.1 microns, to a total point-source depth of r~27.5. The LSST Science Book describes the basic parameters of the LSST hardware, software, and observing plans. The book discusses educational and outreach opportunities, then goes on to describe a broad range of science that LSST will revolutionize: mapping the inner and outer Solar System, stellar populations in the Milky Way and nearby galaxies, the structure of the Milky Way disk and halo and other objects in the Local Volume, transient and variable objects both at low and high redshift, and the properties of normal and active galaxies at low and high redshift. It then turns to far-field cosmological topics, exploring properties of supernovae to z~1, strong and weak lensing, the large-scale distribution of galaxies and baryon oscillations, and how these different probes may be combined to constrain cosmological models and the physics of dark energy.Comment: 596 pages.     Developing a Series of AI Challenges for the United States Department of the Air Force

    Through a series of federal initiatives and orders, the U.S. Government has been making a concerted effort to ensure American leadership in AI. These broad strategy documents have influenced organizations such as the United States Department of the Air Force (DAF). The DAF-MIT AI Accelerator is an initiative between the DAF and MIT to bridge the gap between AI researchers and DAF mission requirements. Several projects supported by the DAF-MIT AI Accelerator are developing public challenge problems that address numerous Federal AI research priorities. These challenges target priorities by making large, AI-ready datasets publicly available, incentivizing open-source solutions, and creating a demand signal for dual use technologies that can stimulate further research. In this article, we describe these public challenges being developed and how their application contributes to scientific advances

    Background Findings from the RESTART trial suggest that starting antiplatelet therapy might reduce the risk of recurrent symptomatic intracerebral haemorrhage compared with avoiding antiplatelet therapy. Brain imaging features of intracerebral haemorrhage and cerebral small vessel diseases (such as cerebral microbleeds) are associated with greater risks of recurrent intracerebral haemorrhage. We did subgroup analyses of the RESTART trial to explore whether these brain imaging features modify the effects of antiplatelet therapy

    Pan-Cancer Analysis of lncRNA Regulation Supports Their Targeting of Cancer Genes in Each Tumor Context

    Long noncoding RNAs (lncRNAs) are commonly dys-regulated in tumors, but only a handful are known toplay pathophysiological roles in cancer. We inferredlncRNAs that dysregulate cancer pathways, onco-genes, and tumor suppressors (cancer genes) bymodeling their effects on the activity of transcriptionfactors, RNA-binding proteins, and microRNAs in5,185 TCGA tumors and 1,019 ENCODE assays.Our predictions included hundreds of candidateonco- and tumor-suppressor lncRNAs (cancerlncRNAs) whose somatic alterations account for thedysregulation of dozens of cancer genes and path-ways in each of 14 tumor contexts. To demonstrateproof of concept, we showed that perturbations tar-geting OIP5-AS1 (an inferred tumor suppressor) andTUG1 and WT1-AS (inferred onco-lncRNAs) dysre-gulated cancer genes and altered proliferation ofbreast and gynecologic cancer cells. Our analysis in-dicates that, although most lncRNAs are dysregu-lated in a tumor-specific manner, some, includingOIP5-AS1, TUG1, NEAT1, MEG3, and TSIX, synergis-tically dysregulate cancer pathways in multiple tumorcontexts

    Pan-cancer Alterations of the MYC Oncogene and Its Proximal Network across the Cancer Genome Atlas

    Although theMYConcogene has been implicated incancer, a systematic assessment of alterations ofMYC, related transcription factors, and co-regulatoryproteins, forming the proximal MYC network (PMN),across human cancers is lacking. Using computa-tional approaches, we define genomic and proteo-mic features associated with MYC and the PMNacross the 33 cancers of The Cancer Genome Atlas.Pan-cancer, 28% of all samples had at least one ofthe MYC paralogs amplified. In contrast, the MYCantagonists MGA and MNT were the most frequentlymutated or deleted members, proposing a roleas tumor suppressors.MYCalterations were mutu-ally exclusive withPIK3CA,PTEN,APC,orBRAFalterations, suggesting that MYC is a distinct onco-genic driver. Expression analysis revealed MYC-associated pathways in tumor subtypes, such asimmune response and growth factor signaling; chro-matin, translation, and DNA replication/repair wereconserved pan-cancer. This analysis reveals insightsinto MYC biology and is a reference for biomarkersand therapeutics for cancers with alterations ofMYC or the PMN
